FSVP: What the Foreign Supplier Verification Program Requires of Importers

FSVP, the Foreign Supplier Verification Program, requires anyone who imports food into the United States to perform a hazard analysis, evaluate and verify each foreign supplier's food safety performance, and keep verification records on file. It's codified at 21 CFR Part 1, Subpart L - a distinct FSMA requirement, separate from a standard domestic supplier-approval program.

Who FSVP Applies To

FSVP applies to the US importer of record for food products - the entity that owns or has purchased the food at the time it enters the US, or the US agent/representative of a foreign owner. If you bring in ingredients, private-label products, or finished goods from outside the US, FSVP responsibility generally falls on you even if your foreign supplier already has its own food safety certifications.

The Four-Step FSVP Cycle

The FDA's guidance describes FSVP as a cycle each importer repeats for every food and supplier combination:

1. Hazard analysis - identify the biological, chemical, and physical hazards reasonably likely to occur in the specific food.
2. Evaluate the supplier - consider the supplier's food safety performance, the hazard's likelihood and severity, and applicable US regulatory requirements before approving them.
3. Verification activity - conduct onsite audits, sampling and testing, review of the supplier's food safety records, or another appropriate procedure, based on the risk the hazard presents.
4. Records on file - document the hazard analysis, supplier evaluation, and verification activity so it's available for FDA review.

FSVP vs. Domestic Supplier Onboarding

A general supplier-onboarding or supplier-quality program - collecting COAs, running a scorecard, approving new vendors - covers useful ground but doesn't satisfy FSVP on its own. FSVP specifically requires a documented hazard analysis tied to the imported food, and a verification activity chosen based on that hazard's risk profile, not just a one-time approval. An importer relying only on a foreign supplier's own GFSI certification still needs to document why that certification is an adequate verification activity for the specific hazard identified.

Verification Activity Options

FDA allows importers to choose the verification activity appropriate to the risk: onsite audits (required for hazards controlled by a supplier that could cause serious illness or death, unless an exemption applies), periodic or lot-by-lot sampling and testing, review of the supplier's relevant food safety records, or another appropriate procedure the importer can justify. Higher-risk hazards generally call for more rigorous verification.
